Xie murder trial aborted amid new evidence

A Supreme Court judge has aborted the trial of the man accused of murdering five members of the same family in Sydney.

Discharging the jury, the judge said new evidence had emerged late last month which may make a substantial difference to the trial of Robert Xie.

Xie, 50, is accused of murdering his brother-in-law Norman Lin, Lin's wife, Lily, their two boys, aged nine and 12, and Lily's sister Irene in July 2009.

Justice Peter Johnson told the jury they were discharged and there would be a new trial with a new jury.

Labor's move to debate Geoff Shaw's future rejected

The Victorian Opposition has been unsuccessful in its attempt to move a motion to debate the future of balance-of-power independent Geoff Shaw.

Mr Shaw faced a push by Labor to have him expelled from Parliament for misusing his taxpayer-funded car and fuel card.

Opposition Leader Daniel Andrews made the request to have standing orders suspended to debate the issue at the start of Question Time today, but it was refused almost immediately by Speaker Christine Fyffe.

Mr Andrews called the Premier's decision "an act of weakness", and said Labor would move to find Mr Shaw in contempt when it sits on Wednesday.
